SALE TERMS
Upon conclusion of auction Sellers and Buyer shall execute a purchase agreement with Buyer to pay Ten Percent (10%) of purchase price as down payment. Balance due and payable on, or before, May 3, 2010 at which time possession will be given subject to 2010 farm tenancy of current tenant, and current tenant shall be entitled to 50% of the crops harvested off the premises in 2010, the tenants’ share of any and all government farm program payments for 2010, and shall have exclusive access and use of the grain bins located on said premises through March 1, 2011; Subject to the tenants right to the exclusive access and use of the grain bins located on said premises through March 1, 2011, buyer shall be entitled to possession of the premises after removal of the 2010 crop. Sellers will convey by Judicial Deed and furnish title insurance for amount of purchase price. The property is being sold “AS IS”. Procurement of financing shall be the sole responsibility of the Buyer, and must be obtained prior to the auction. REAL ESTATE TAXES: Sellers will pay taxes for 2009 payable in 2010. Buyer will pay the 2010 and subsequent taxes.
• The Buyer shall purchase one-half
of the seed soybeans for the 2010 crop. The 2010 tenant has already
purchased his one-half of the seed soybeans, which are Roundup Ready 2
soybeans. Chemicals not yet applied, buyer will be billed for 50%
directly from the supplier.
